What To Do If a Roofing Contractor Cashes a Check Before Insurance Pays

If a roofing contractor cashes a check before your insurance company pays, it can create immediate financial stress — and in some cases, real out-of-pocket costs. That is what happened in my dispute with BA Roofing Cullman. I signed a $2,500 check over to them with the understanding it would be held until my insurance paid out. When they cashed it early, my account went negative and I was hit with an overdraft fee.

1. Gather Your Documents

5. Contact Your Insurance Company

Let your insurance adjuster or claim representative know what happened. Ask whether any payment has been issued to the contractor and when. Confirm in writing what the insurance company’s process is for paying contractors versus paying the homeowner.

6. Ask the Contractor for a Written Explanation

Keep the message professional. Ask specifically: why was the check deposited before insurance paid, and will you refund the amount plus the overdraft fee it caused? Request a written response.

7. Consider Filing Complaints

Depending on your situation, you may consider filing a complaint with consumer protection agencies, licensing authorities, the Better Business Bureau, or review platforms. Stick to facts — the amount, the date, the agreement, the overdraft — and avoid exaggeration.

8. Consider Legal Advice

If the amount is significant — even a $2,500 check plus overdraft fees qualifies in many small-claims courts — a lawyer may be able to explain your options. Every situation is different.
